Hi All

Very many thanks for all your help and I’ve been trying to get my head around all the information.

The 1881 and 1891 census show Arthur’s mother as Phoebe (formerly Drane) , 1881 census and marriage certificate confirm his father was James the Butler. The census records also show his siblings Ada, Frank C, Arthur, Percy, Ethel A.

The 1901 census is a little muddled but looking at the original I’m pretty sure that Arthur Ganard is Arthur Garrad. He could have given an older age to secure his job. He does however say that he is married, the census being taken the week before his marriage. He is an Ironmonger on the census which is what he shows on his marriage record.

Kate in 1901 is shown with her family and single. A week later she marries Arthur.

Possible that he was the soldier who went to the Boer War in 1902. Maybe he decided to stay over in South Africa and started another family? The South African Ancestry site shows several similar surnames but don’t know if any are descended from him – I don’t have paid access.

Kate married for the second time in 1911 although the census shows her as having been married for six years. If he “disappeared” it is supposed to be seven years before marrying again. The six years could be common law marriage.

Phoebe in the 1911 census shows that she had five children and one has died. It looks as though Ada died in 1895 which means that Phoebe doesn’t consider that Arthur is dead.

Was the 1901 Arthur a different one or was he already married?

Bring on the 1921 census – it might help!

I have just found an Ancestry site which has Arthur on it – unfortunately the site only shows his birth, parents and a couple of siblings. I’ve contacted them in hopes of finding out more.

Many thanks all. The census records sound right although the 1901 census sounds strange with the different birth place. I'm sure there aren't many ironmongers of the same name so it must be him - although I have Kate in the 1901 census as single and living with her family. Curiouser and curiouser!!

Australia off to bed now - it's a nuisance having different time zones.

This could be Ada's death which would mean Arthur could still be alive according to his mum

I spotted the other census returns........... but I can't see this Arthur before the 1901 census......... so I think it maybe him.

If he lied about his year of birth and birth place what else is he covering up.... just a thought.

For "declared dead" -- it wasn't actually a declaration. After seven years without contact and no information, a spouse was entitled to presume the person was dead and consider themself free to marry again. The seven years provided a defence against any bigamy charge.

I had wondered about that possibility. 1911 would put his last known existence at 1904, if that had been the case.

I don't know how common this was, for instance how familar people were with the rule, or even how it was implemented. When I read up on a bit a little while ago, it sounded like someone could just say to themself: well, I'll consider him/her dead, time to get married again! ;)
