Hi,
Does anyone know the answer?
I've been pondering the following situation.

Miss Y has a child with father Mr X who was married at the time to Mrs X. named 'child1'
Mr & Mrs X legally adopt 'child1'.

Later Miss Y has another child by father Mr. W. named 'child2'.

Mr. & Mrs X divorce some years later and Miss Y marries Mr X.
After the marriage is 'child1' the son of the new Mrs X or the stepson?

i would say a bit of both because if it was a legal adoption then Miss Y has given up her legal rights to the child so Mrs X ( the first one) is the childs mother.
As Miss Y marries Mr X she is then technically the childs step-mother but also biological mother.

legally he is her stepson because he became the son of mr & mrs X when he was adopted by them

Legally he is the son of his adopted parents, ie the 1st Mrs X, and under inheritance laws he would not be considered the son of the new Mrs X unless she adopted him.

Hi All,
Isn't life strange at times. How a son becomes his mums stepson is really weird the more I think about it.
It was watching Heir Hunters today that left the thought in my mind as they were discussing a case where if the children had been adopted then they lost the rights to any claim of an inheritance the Heir Hunters were working on.

Thanks to all who replied as you seem to have reached the same bizarre solution as I have.

I watched that programme too.....I think if he HAD been adopted he would have been able to inherit from his adoptee parents to the same degree as a natural - born child of his adopted parents' marriage.
You can't have it both ways, I guess.
