Yes - a tenancy (and usually what we now call a leasehold) CAN be inherited. (Not the sort of weekly tenancy we think of such as council housing!)

A person may have taken on a 99 year lease of a house or farm etc and lived there for 37 years - the remainder of the "lease" - ie the tenancy can be inherited, and if its a farm ,then clearly is valuable as a source of income.

Long leases are much less common now, due to Leasehold Reform legislation, where tanants have been given the right to "buy" out the freehold in lots of cases.

I have gathered the following information and am trying to find a logical explanation for it all - all theories welcome

Isaac Leney being assessed, as occupier, for land tax at Burstow

Isaac Leney of Smallfield Place makes will 11 Jun 1835 with son John and son-in-law Thomas as executors (ignoring eldest son and 5 other sons-in-law). All his children receive bequests and the residue of estate is left 50/50 to John and Thomas.

Valuation Smallfield Place from Isaac Leney to Thomas 20 Sep 1836 (£664-01-06).

Valuation Old Rowfant farm from Thomas to John 07 Nov 1836 (£489-03-09).

Unable - as yet - to find any sale transaction of the two properties above.

Isaac Leney dies 08 Mar 1838/will proved 05 May 1838

1841 census has John at Rowfant and Thomas at Smallfield Place

My queries are
Can a tenancy be inherited?
Is it possible for a valuation to be carried out for a tenant rather than the owner of a property?
Is it reasonable to suppose that John was 'given' Old Rowfant farm by Thomas in return for his 50% of Smallfield Place?

Any help appreciated
