marriage - sherriff warrant

In Scotland there were, until 2006, so-called irregular marriages. A marriage need not be performed by a priest, and certainly need not be performed in a church. Perhaps the most widely known are the "anvil" marriages performed before the blacksmith at Gretna Green. Marriages like this ceased in 1929, but thereafter one could still be married by cohabitation and repute - what would be called a common law marriage in England. Although termed irregular, they were/are still legal marriages, Even today, if you contracted a legal marriage before the relevant change in the law, you could still appear before the sheriff to have your marriage recognized. If he were satisfied that a legal marriage did exist, he would issue a warrant to that effect. This could then be taken to the registrar to register the marriage. |

can anyone provide more info on why on a marriage cert 1879 - warrant of sherriff ?? would appear under witness section? |
