Just a few thughts about possible paths you may be able to take.

What I would do is to contact these people. If you have not already.

https://submit.justice.vic.gov.au/CA25691800094F30/BDMTransFeedback?OpenForm

Give them the details of your search. You are going to have to name names and dates and give any info you can.

You may already have this info. It won't hurt to ask again to see what comes up.

With regard to the NSW BDM bit. Try to find the death certificate. I don't have any names so I can't do it for you. You are able to search the NSW BDM just using given names. The search can be up to 1978. I know that's only 31 years ago but it is worth a try. You will need to know the name of the baby's mother, and the first names of her mother and father.

If you can not locate the death certificate write or email NSW BDM with your enquiry. Mail is better. Make certain you enclose copies of the required documentation including anything official you have for the adoption. In this case asking is the only thing that will get you anywhere.

I do not have name on marriage, or names of children or death if she has passed on.

I have all info on the adoption Or can get it quite easily. I have found the shipping records out of Australia and I have found her getting back on the ship in London. Unfortunately when the ship landed in fremantle she did not appear to be on board suggesting
1. she got missed off record
2. she disembarked on route
3. she married on board and took up new name( not sure if possible)

It is the recollections of an elderly uncle ( fathers side, whom new of affair and adoption and is clear headed despite age) that states she married and lived in NSW and went on to have family.

So adoption took place in Victoria. This may change the info. I have knowledge of how the adoptions are handled in NSW. The procedure does not work in NSW if the birth, adoption, etc took place in another state. Which in this case it did.

I don't quite know how to advise in these circumstances. The only records you are likely to find in Australia are
Arrival in South Australia - depending on the year may show on an electoral roll.
Birth of child in Victoria, baby's mother and partner may show on electoral depending on how long they stayed in Victoria.
Adoption of child in Victoria.
Return of mother to UK
Arrival of mother back in Australia
Marriage of mother
Birth of other children
Death of mother

That the mothers marriage took place after 1958 complicates things as you are aware. So how much of the above info do you have. I am going to look at something in the NSW BDM. I shall return.

I am totally unaware of this. I have been trying to do random searches online.
I did not know he is entitled to a marriage search... that is very interesting...
I believe he got his adoption file ages ago, and found the whole thing too difficult/ confusing.

Birth mother was born in UK , emigrated to S.A with the family, fell pregnant in SA , went to Victoria with lover had baby and adopted him out,, returned back to UK for a few years then went to NSW where she married and had a family.
That is the sum total of my knowledge and I have spend many many hours getting that far.. :-}

The birth father was so easy( it still took weeks).. the fathers family placed an obituary and the name was unique enough to follow...

So this person has the Supply Authority from Department of Community Services. This Authority entitles them to the following information. They may or may not have already accessed this info.

The info is contained in the letter entitled Adoption Act 2000. I won't quote it all here but if you need the info please let me know.

What you are entitled to ask for is:
Original Birth Certificate
Amended birth certificate
birth Extract of Birth Mother (if born in NSW)
Marriage Search
Death Search

Part of the info states It is recommended that if you are searching for a female, a marriage search be requested before a death search.

There's other info about the forms of identification and paying the fee and supplying a copy of your Supply Authority.

So how far are you through this process, are you aware of this info, there is a phone number you can call for more info.

I am so so sorry for my late reply. i had intended to stay on line for a few more hours after I posted but after the internet went down went to bed. I was unable to get on after work the next day and unfortunately got side tracked. :-(
Thankyou Cynthia for reminding me..... Id forget my head if it wasn't screwed on.....

You are correct in thinking that this is a adoption, that is been held up purely by the married name of his mother. Any suggestions would be gratefully recieved.

The adopted person has his adoption file...It is very detailed . His biological fathers family knew of the mother but unfortunately do not know her married name or where abouts.

I applied for my grandfathers birth certificate, as he was born after 1908 (1912) and all parties are now deceased, I still had difficulty getting the Certificate. I had to tell them his date of birth and date of death (had to send a copy of the death certificate), my mothers date of death, supply 4 forms of ID. After 9 weeks it eventually arrived. Even though I am now living next of kin it was not easy.

I would say unless this person is next of kin to both parties they will have trouble accessing after 1958 marriage certificate. If both parties are now deceased, their children can apply. Still they will have trouble getting the information.

Good luck anyway

Gail

Just had another thought. You are talking about a biological mother/father. Does this involve an adoption? If so there is more you can do. Let me know if you need this information.

AuntySherlock

AuntySherlock Report 16 Aug 2009 09:55

Aussietrish. You may not have access to marriage records after 1958 in NSW. Not even the people who run transcription services are allowed to have them.

You may be able to obtain the certificate or info from the certificate if you ask your friend to complete the on line application form (on the NSW BDM site - historical indexes).
http://www.bdm.nsw.gov.au/familyHistory/stepByStep.htm

Fill out the form giving as much info as you can. The closer a relative or next of kin you are the better chance. You will have an even better chance of a positive reply if the person concerned is deceased and you know the reference number for their death certificate. You can search for deaths up until 1978.

I have a similar frustration and there is nothing much you can do about it.

If you would like more information about this try contacting Joy Murrin transcription service. Google the name. They know all the ins and outs of NSW BDM.

Good luck and if you have a breakthrough let me know so I can try the same strategies.

I have found more info on my friends biological mother and need to access the marriage index for NSW after 1958. We do not have enough info to be able to apply for a marriage cert. Without the info I cannot find his mother, whom we know married and went on to have futher children. Any suggestions please.

NB> I have managed to reunite him with his biological fathers family. :-)
