Probate help needed

Can anyone help me understand why Maria Spain died 19 Sep 1858 but the probate is dated 20 Aug 1875 also her spouse Thomas died 13 Oct 1858 and probate was 28 July 1875. The records are listed with Maria first then underneath Thomas.
Any help to understand this would be very helpful.
They both died in Saltwood near Hythe but probate was awarded at the Principle Registry to one of their sons who lived in Ardwick Manchester.

There may have been conditions in the actual Will that expired in 1875.
Possilby Bonds.or a partnership somewhere?


A full copy of the Will with details will shed light.

From the probate office where the Will was proved.....

they cost £5 by post,or about 50p on the spot if there is a public office near you where you can walk in.

York is one of the more directed places only by post ,some Central Libraries hold older dated copies

The records show that their son John had been granted letters of administration for their effects

This means that they had not made a will

So John would have to pay off any outstanding debts etc which might account for the application not being made until 1875
So If you appplied for the records all it would state is the value of the and that their son John applied for letters of adminstration

I have recently obtained details of one of my Channel Islands relatives which had to go to the high court in London and all it says is that the husband of the deceased applied for letters of adminstration because his wife had not made a will and the value of her estate

Thank you so so much for your help. That makes a lot of sense Bren, that having to pay off debts would make it a long drawn out affair and more understandable why there were so many years gone by.
I was worried that I had gone wrong somewhere.
