Lyndsey This link gives you some information http://www.familyrecords.gov.uk/frc/research/willsmain.htm (very) Simply put - The Will contains the instructions and wishes of the deceased person. The Probate is the permission for the executors to 'execute' the Will in accordance with the instructions and wishes of the deceased. The above link has addresses etc which you may find useful. hi, my dad died dec last year. we know he had a will made out because my sister wrote the cheque for it. we found it after he died and it wasnt signed by either him or any whitnessess and we were told by a solicitor that it wasnt valid as it hadnt been signed. luckily for us there wasn't anything in it except that we could have what we liked out of the house and split the cost of anything we sold. |

Thanks OC. A bit disappointed as would loved to have seen his actual signature. There is his name and a line for him to sign and then the witnesses names and spaces for them to sign but nothing. I also have a copy of Probate as well Linda |

The Will SHOULD have been signed...but when my mother died, we were all horrified to find she had not signed her Will. This was despite going to the Solicitor's Office with my father - they had made mirror Wills and went together to sign them in his office. The witnesses had signed - but not mum. We think she must have started chatting with the pen in her hand!'!!' However, it didnt matter - unsigned Wills are taken as 'intention' and can be proved on that basis. OC |

Received my Great Great Grandads will today. I was disappointed to see that he had not signed it.... there was a place for signing but no signature....was this normal? ....Found out though that he had never married my GGGrandmother despite all the childrens birth certs. stating Mary Anne Glasspool formerly Angliss......Will says sole beneficiary Mary Ann Angliss... Spinster.......So never believe all you read.... Linda |
