Missing presumed dead

It seems that "missing presumed dead" means exactly that. It has no legal status at all. After 7 years a spouse can seek a "decree of presumption of death" in order to re-marry.

I think you will find they also have to make an effort to find the missing person in those 7 years but what the entails I don't know. Irene

Think its 7 years - though how they determine it I've no idea but there must have been no contact with anyone including govt agencies etc surely.

When someone "disappears" - particularly in the case of a spouse, after a certain time - I don't know the exact years - you apply to a court for a "missing presumed dead" order so that their affairs can be wound up and any spouse is free to remarry.

Under what circumstances would a "missing presumed dead" announcement be made apart from the war? Be glad of some help. Thank you in adavance
