we have BIG problems with them next door we have done everything to help ourselves .
our housing ass will not move us coz they wont find anyone to put up with them next door like we do
Now on saturday my hubby was attacked inside our house by their 21 year old child! hes been charged
How do we get an injunction out on them it seems so easy i cant believe its right!!!

Kemp that is utterly horrific and must have been so frightening!!! How is your husband doing??

You could contact CAB or is there no one within your housing association that can give you some help and support.........

CAB or if more urgent, phone a solicitors. They will normally give 30 minutes free advice.

If you go forward with the injunction, the Legal Aid system was changed a few years ago. The cost may not be viable

Try pushing the HA to evict the neighbours.

Added - talk to the Police again. Assuming that the man has been granted bail, they could add a clause prohibiting him from making contact or threatening your family

I believe local authorities and housing associations have a legal duty to take steps to deal with unruly/unsociable tenants - have you contacted the local councillor or your local MP and sought their help?

Hubbys face is very swollen and black and blue !

Housing ass cant even get them to call us back !!! dont know what to do???

sorry peeps

BUT they own their house they are first class we second

CAB said read whats on their site and go from there

it seems to say get forms for injunction from county court and file with them for a cost

we wont get any money help at all we both work


added we think the police told them to stay away coz they arrested his father aswel for obstructing the course of justice coz he wouldnt let the police speak to the 21 year old
father 50 charge obstructing course of justice
child 21 charge ABH

go to your housing office and inform them
they have a
duty of care to see that you can live in your home in peace and safety
I myself work on a ASBO panel for a housing association
the trouble is it can take two years to evict a tenant
and can cost up to 40 grand in legal fees
that's why they are reluctant to help you
but if somebody is hurt its time for them to step up
as the police can provide the evidence they need to start the proses
remind them of the Pilkington's and what happened
when they got persecuted no housing ass will want a repeat of that
and if that fails seek legal advice remember the first half an hours free

just because they own there own house
doesn't mean your housing ass cant still help you
they could move you for your own safety


BUT if it was a racial issue
you would have everybody falling at your feet to help you ;-) ;-)

From the Citizens Advice Bureau website - What the local authority can do

As a person who is suffering anti-social behaviour you can ask the local authority to deal with it, regardless of whether you are a local authority tenant or not. The local authority can:

apply to a court for an order to stop or prevent someone's anti-social behaviour in its area

in England and Wales, apply to the court for an order to stop gang violence or to protect someone from gang violence

in England and Wales, apply to court for an order to close premises where there is ongoing disorder or nuisance

take action to stop noise, nuisance and threats to health

take action to evict the person responsible for the behaviour, if they are a local authority tenant

offer the victim alternative accommodation

prosecute where the behaviour is a criminal offence

in England and Wales, take over management of a property where there are particularly serious anti-social behaviour problems.

If you want to ask the local authority to take action about anti-social behaviour, you should consult an experienced adviser, for example, a Citizens Advice Bureau. To search for details of your nearest CAB, including those that can give advice by email, click on nearest CAB.

Shame that they are homeowners in that case.

Definately talk to the police. Assuming they are taken to Court and found guilty, the Magistrates could probably add an Anti Haressment clause to the sentence.

Until that happens, may be the police can have another word with them?

Oh yes, people in The Towers (Wevebaw Towers).

My neighbours are alright but their married daughters, who live in housing association properties themselves, are the children of homeowners so they are superior and must be allowed any concessions they want.

They have tried to be threatening in the past but they soon got tired of being treated like irritating insects!

Surely your HA has an obligation to house you in safety. The stress can't be doing much for your health either, get the doctor on your side.

Sharron My hubby has a major heart problem BUT in this area it is known that a doctors note means NOTHING at all to the HA to get people moved they have had so many that they dont count them anymore

The police should help you & get your local mp involved .you shouldnt have to put up with that treatment at all.local council should help as weill. doesnt matter they own the property .you have as much right as any body to not feel threatened in your own home Good Luck

Kemp can't add anything to the help above although you could involve your local MP. I expect people will be wary with a prosecution pending as they won't want to prejudice the case. Meanwhile I hope your housing association sees sense and gives you some help. <3

I have looked at the MP website it says they dont deal with this sort of case!
