Have you taken photos of your husband's injuries?

Might be useful when arguing your case to whoever you need to.

Kay????

Kay???? Report 11 Nov 2014 14:33

The local county court can draw up an injuction for you to take cilvil action against him,,,

Did your OH press charges or offered to press charges.?

Hi Kp, have you been referred to victim support,if not you should have been,i have suffered for 5 yrs with my next door neighbours son,he was given asbos and 6 mths suspended sentence he still continued when the 6 mths were up ,but will say victim support were good, they provided me with window alarms free annd one to one support .so contact them get a crime report number from the police that charged him.so the victim support group have something to refer to and keep a diary of all things that happen to you.time date etc,and if possible photo evidence as well.
hope this helps.best wishes

The following is a quote from a long reply on a Chat Board to a victim of domestic violence, a few years ago.

The cost may be changed, but the rest is probably the same. The advice will be free and you will be helped with the forms (short of them actually filling them in!!).Just go to your local County Court and tell reception what you want.

Don't be nervous - they are there to help. And the very best of luck!

*************************************************************************************

You can apply for a Non-Molestation Order from the local County Court. This court order can be used to prevent someone causing trouble, pestering, harassing or threatening someone deliberately either in person or through a third party. The cost is about £60 but this will be waived if you are on a low income. The order can take a long time if going through a solicitor but if you apply to the county court yourself and are competent in filling in all the forms you can get the order within a few days. If you use a solicitor you will also have to pay their fees.

Looking at this page

http://www.ncdv.org.uk/are-you-suffering-domestic-abuse/how-the-law-can-protect-you/

it seems that a non-molestation might not apply in your circumstances, it seems to be more for family members etc

"(2) When you can apply.

Applicant and Respondent are associated persons
This is determined by s.62(3) of the Family Law Act 1996 and covers most relationships, including:
Partners and former partners
Family relations (including in-laws)
People who live(d) together
People who have children together"

Its the Small Claims Court that deal with civil matters,,,,,,,there is bound to be one in your area,,,,,,,,,the police will know,a solicitor will know,,,,,usually there is a small claims court dept within a local county court, where all the local cases are heard,,,,,
